Conditions of sale

In this Condition of Sale, the term "We", "Us", "Our", and "trickyLux" refers to trickyLux and its owners, while "User", "He", "You", "Your" or "Customer" refers to the person or entity specified on the sales order. trickyLux and the User constitute the two "Parties" in these Conditions of Sale.

The User is encouraged to carefully read this terms of sale, and to use it to make informed decisions before accepting, purchasing, and using the trickyLux devices, documents, and software.

By purchasing or using trickyLux devices, documentation or software, the User fully accepts all the terms and conditions expressed in the present Conditions of Sale.


Taking of responsibility

All trickyLux devices, documentation and software are provided on an "as-is" basis. The User assumes all responsibility for any direct or indirect damage caused to them, third parties, animals, or things, deriving from the use of trickyLux devices, documentation or software.

The TL-PLS devices and software also allow to remotely control the electrical utilities connected to them and located in inaccessible or not directly observable places. By accepting this Conditions of Sale, so taking all responsibility, the User represent and warrant He will use appropriate safeguards to minimize consequences associated with the use of the trickyLux devices, documents, and software, ensuring that no action taken can cause damage to people, animals, things, or environments, and that all connected devices, even remotely, are installed and configured correctly and in such a way as not to create any dangerous situation for people, animals, things, or environments.

Before using the trickyLux devices and software, the contents of related documentation must be fully read and perfectly understood by the User, and all the necessary knowledge must have been acquired so to be able to install and use the trickyLux devices and software in total safety, adopting all necessary safety measures.
In order to operate with the trickyLux systems, the User must have at least the following skills: design of the entire trickyLux system to be implemented; electrical design; mechanical assembly; electrical wiring; devices configuration; tests with disconnected electrical utilities, tests with connected and powered electrical utilities. Only after the execution and successful outcome of all the steps described above, the trickyLux system can be put into service. If in doubt, the User will stop installing the system and will contact a technical office expert in the related subjects.


Limitation of liability

Under no circumstances will trickyLux, its owners, associates, officers, directors, shareholders, predecessors, successors in interest, employees, be held liable towards the User or third parties, for any direct or indirect damage caused to them and deriving from the purchase and use of trickyLux devices, documents or software.


Resale

The Customer is allowed to resell the trickyLux devices to third parties, only with and under the same conditions of sale reported in the present Conditions of Sale. The Customer is not allowed to resell any trickyLux software or document already made available for free on the trickyLux website www.trickyLux.org.


Relationship of Parties

Nothing contained in these Conditions of Sale shall be construed as establishing or implying any partnership or joint venture between the User and trickyLux, and nothing in these Conditions of Sale shall be deemed to construe either of the User or trickyLux as the agent of the other.


Intellectual property and proprietary rights

The provided trickyLux software and documentation, are proprietary to Us and protected by copyright and other intellectual property laws.
The software and documentation can be used on an "as-is" basis, and the User may not remove any trademark, copyright, proprietary rights, or confidentiality notices, included within the software or documentation.
The User may not change the trickyLux software or documentation, nor the content of the devices.
The User may not rent, lease, license, sell, sub-license, assign or transfer any trickyLux software or documentation.
The User may not directly or indirectly attempt to decompile, disassemble, teardown, or reverse engineer any trickyLux device or software.
The User may not use the trickyLux devices or software for any prohibited use.
The software may contain third party or "open source" software. We will provide attributions and terms relating to such open source parts, along with the applicable source code, where required.

The trademarks, service marks and logos, used and displayed on the trickyLux devices, software, and documentation, are trickyLux's, registered and unregistered trademarks. All trademarks and service marks of trickyLux that may be referred to on the devices, software and documentation, are the property of trickyLux. trickyLux is the copyright owner or authorized licensee of all text and all graphics contained on trickyLux devices, software and documentation. Nothing on the trickyLux devices, software or documentation, should be construed as granting, by implication or otherwise, any license or right to use any of trickyLux's trademarks or service marks without trickyLux's prior written permission.


Orders cancellation

Orders can be cancelled only before dispatch, by writing to Us at info@trickyLux.org. Once cancelled, complete amount will be refunded.

All trickyLux devices are visually checked and tested before shipment. In case the product does not pass Our quality control, We will return the product to the Customer, only after the Customer has bore the whole courier's costs, both for the shipment of the product to Us, and for the shipment to receive the product back as it is. All shipping costs will not be refunded.


Taxes

Items sold by trickyLux are subject to sales/use and/or excise tax in select states in accordance with the applicable laws of each state. Certain states require the purchaser to file a sales/use and/or excise tax return and pay the tax on online purchases made from out of state. It is the Customer responsibility as the purchaser to check Your state and local tax laws and to comply with their requirements.


Payment policy

Payment for any products ordered from Our Site, must be made in advance by credit card, debit card, or PayPal.
At the time of placing the order, the transaction details are presented to the bank and payment is collected immediately. If the bank's authorization is not obtained, the order will be cancelled. We may carry out certain fraud checks with the cardholder or the cardholder's bank; should We be unable to verify the validity of the transaction the order will be cancelled.
We do not collect, store or process Customer's card or banking account details. Our payment service provider, will process the card details or banking details for the Customer, and display them to Customer later on the payment page of the site.
